A vote "yes" would put into effect House Bill 545, which changes the regulations on check cashing lenders, or "payday lenders." The bill, which the General Assembly has passed and the governor has signed into law, would put a $500 limit on short-term loans. The current regulations limit short-term loans to $800, but include no minimum period for repayment and no limits on interest rates. In addition, the new bill would give borrowers at least 30 days to repay the loan, and it would limit annual percentage rates to 28 percent. For comparison, The Ohio Coalition for Responsible Lending has estimated the average APR on payday loans to be 391 percent, though that figure must be taken with the understanding that it comes from an interest group.

"Ballot issues summary"
October 23, 2008 - The Youngstown Vindicator
Payday lending. The referendum calls for changes to portions of the payday lending reform law enacted by lawmakers and the governor earlier this year. A vote of "no" would change the loan cap (to $800 from $500), remove repayment periods (30 stipulated in the law) and increases allowable annual percentage rates on loans to a rate "that substantially exceeds" 28 percent.

"Approve limit on payday lenders"
October 23, 2008 - The Newark Advocate
As part of my job, I worked hard helping bank customers keep their bank accounts in the black. Those customers who were dealing with payday lenders were always in need of my assistance to fix problems. It seems to me that this is the worst kind of predatory lending; it preys on those who already need help just to keep afloat. If this type of lending is truly needed, certainly even 28 percent interest sounds like quite a lot. It costs less interest to get an advance on a credit card.

A no vote says essentially the payday lending law will not go into effect, and payday lending organizations will operate exactly as they have been," he said.

"Yes on Issue 5"
September 14, 2008 - Akron Beacon Journal
In a stunning turn this summer, payday lenders lost their legislative battle to prevent passage of an Ohio law that caps the interest rate they are permitted to charge on small loans. The lenders responded with a strategy: If you fail in the Statehouse, take the fight to the streets. They have submitted signatures petitioning to place Issue 5 on the Nov. 4 ballot. The statewide referendum would be the lenders' effort to reclaim what they lost: the opportunity to charge interest amounting to a 391 annual percentage rate on small, short-term loans.

August 22, 2008 - The Akron Beacon Journal
The Ohio Legislature passed a bill earlier this year that severely restricts interest rates lenders can charged on so-called payday loans. The bill, signed into law and set to take effect Sept. 1, does not outlaw the loans, however, as the ad suggests. It limits such loans to four per consumer per year and restricts the interest rate that can be charged. An issue opponents of the law seek to get on the November ballot would repeal those two provisions.

"Scoundrels"
August 23, 2008 - Zanesville Times Recorder
On Sunday, I was at the Colony Square Mall with my dad. As we were exiting the mall, a young solicitor seeking signatures asked us to sign a petition to drop interest rates on loans from 35 percent to 5 percent. I recognized immediately that this was a fraudulent representation as this was for the payday lending industry initiative and we walked away. The proponents of turning over the legislation to protect Ohioans from predatory lending practices are apparently stooping to lying to get their initiative on the Ohio ballot.

"Board decision sets up a Yes or a No vote"
August 18, 2008 - The Canton Repository & Toledo Blade
Payday lenders in Ohio won two battles this week. The Ohio Ballot Board, which determines what language is to be placed on a ballot, sided with lenders who objected to language that would have detailed how much interest they conceivably could charge on a loan...as much as 391 percent. The panel concluded that allowing such information would be prejudicial.

"Financial freedom isn't free"
August 17, 2008 - Akron Beacon Journal
The poor payday lending industry is being picked on by a group of people who want nothing more than to displace 6,000 workers, shutter the doors of 1,500 storefronts statewide and lower interest rates on short-term loans from 391 percent annually to a measly 28 percent.

"Payday lenders are still hungry to cash in big"
August 18, 2008 - The Dayton Daily News
The payday lending industry has decided that, by hook or crook, it's going to overturn a new state law outlawing it from charging exorbitant interest rates. It really thinks that if it spends enough money peddling enough lies that people will support having a "choice" to be ripped off.

"Payday loan petitions doubted"
August 13, 2008 - Public Radio
Ohio's payday loan stores are working to overturn a new law that limits the interest rate they can charge for short-term loans. Storeowners are paying for a petition drive. They want to collect enough signatures to force a statewide vote on the new limits in November, hoping that voters will reject the law. Some petition circulators, though, are using a misleading sales pitch to convince people on the street to sign their names. Ohio Public Radio's Bill Cohen has the story.
